I was surprised when I ran across this article recently: Survey finds many not meeting HIPAA security rules (free registration required). According to the (small, maybe not representative) survey, âa large segment of healthcare organizations are still not in compliance with the federal Health Insurance Portability and Accountability Act of 1996 and more than one-quarter reported data security breaches, but there is also a lack of concern about the situation.â?
I wasnât so surprised about the noncompliance, but rather about the reasons for why people werenât complying. When asked to rank their biggest obstacles to HIPAA compliance, respondents placed "no public relations or branding problems anticipated with noncompliance" and "no anticipated legal consequences to noncompliance" at the top of the list.
This survey was conducted from June 1 to June 20 of this year, so respondents werenât affected by the news that CMS would delay payment to those providers who arenât HIPAA compliant. If increased security isn't motivating providers to comply, Iâm not sure that delayed payment will either.
